wind farm electricity company to take protesters to court for lost earnings?
Hi, Two years ago a wind farm for several turbines was proposed for a part of Devon , many locals protested against the plans (i wasn’t one of the protesters) for two years but eventually the Company has now won in court….now the Company is suing the protesters for lost earnings over the two years that they would have been active if there was no protests against their plans…
ive heard this second hand and only know the basics of it so it could be that the Company has threatened and not actually IS going to sue, but anyway if they going ahead with it surely they will never win, will they?

If the company had planning permission and the protesters stopped them building then they could take it to court and win as the protesters were stopping something which was legal and thus causing the company “hardship” and extra cost.
If the planning permission had not been granted previously and they only gained this through the high court then no. They will not win as they had no planning permission then no opportunity to lose anything in the first place.
